Saudi Arabia extends maternity leave under revised labour law

As Saudi Arabia welcomes diverse talent from across the globe to contribute to its economic diversification, laws are being rewritten to accommodate this dynamic, new talent pool. The Ministry of Human Resources and Social Development in Saudi Arabia has unveiled major revisions to the Labour Law that took effect on Thursday, February 20th. 

The new rules include 12 weeks of maternity leave for female workers, with six weeks designated as mandatory leave after childbirth. The remaining six weeks can be taken at the employee’s discretion, as per the amendment.

According to a report by the Saudi Gazette, women may begin their maternity leave four weeks before their expected delivery date. 

In addition, the reforms introduce bereavement leave, allowing workers to take three days off in the event of a sibling’s death. Employers now have the option to offer vacation days in exchange for overtime hours, provided the worker agrees.

Changes have also been made to the notice period for contract termination. If the worker wishes to terminate their contract, they must notify the employer at least 30 days in advance. On the other hand, employers must give 60 days’ notice before terminating an employee’s contract.

The law sets a 180-day probationary period during which either party can end the contract. Furthermore, the amendments emphasize equal opportunities and forbid discrimination between new and existing employees.

Employers are required to provide housing and transportation or offer equivalent cash allowances. Additionally, proper documentation of employment contracts must be maintained, in line with the regulations.
